GANGTOK, 28 Jan: The Sikkim Land Bill 2014 tabled in the State Legislative Assembly today deals with consideration and updating the records of Rights of persons allotted government land in the state prior to the appointed date i.e 26 April 1976. It also deals with consolidation and updating records of Rights of the heirs and descendants of the person allotted government land prior to 26 April 1976 in the state.
Chief Minister Pawan Chamling while tabling the bill said that due to passage of time such consolidation and updating of rights and liabilities of such land holders requires to be compiled, consolidated and updated with records of rights to avoid any confusion over the nature of such land holding and the records pertaining thereto.
The proposed bill states that any person holding any government land allotted by any authority of government prior to appointed day irrespective of the nature of the land shall while continuing to hold such land will enjoy such rights and liabilities as applicable in relation to such land and their heir also shall continue to enjoy such rights and liabilities in respect of such holdings.
Sub-section (1) of the proposed bill states that this is applicable only with respect to such land holding which were government land at the time of allotment and obtained through allotment order of the government.
The proposed bill under the caption ‘procedure’ states that a person holding such land either by the way of allotment or otherwise shall appear before the prescribed authority for obtaining registration and mutation of the land in those cases where no such registration and mutation have been done.
On receipt of the application for registration and mutation the prescribed authority will verify the same inviting objection and dispose the matter within the period of 30 days.
The bill will be taken up for discussion and voting in the Assembly session on Wednesday.
