GANGTOK, 22 May: The Division Bench of the High Court of Sikkim has directed Project Swastik to carry out a reassessment of the compensation to be paid to people whose land the army has been using. In the petition filed by members of the public of North Sikkim it was brought to light by Dr. Doma T Bhutia, amicus curiae, that the Chief Engineer, Project Swastik had not paid compensation for the temporary acquisition of the land.
The petition was filed in the year 2012 by the petitioners who were aggrieved of the fact that while the army had occupied their lands they had not been compensated for many years. Earlier, too, the court had directed that the rates of compensation be assessed for payment to the affected.
It was brought to the notice of the court that assessment for compensation was contrary to Rules. In addition to this it was also brought to the notice of the court that Project Swastik, in fact, was in possession of more land whereas compensation had been assessed for less land. A direction for re-assessment was sought for the full land acquired by the army in this regard.
The High Court agreed to the prayer, and the Chief Engineer, Project Swastik, who was present during the last hearing, was directed to re-assess the compensation to be paid to the land holders for temporary acquisition of the land along with the necessary documents of the land which had been acquired on temporary basis. A time period of 4 weeks has been granted by the court for the reassessment.
