High Court admits State’s appeal against ‘Spiderman’ acquital

GANGTOK, 15 Sept: Following the acquittal of Rakesh Rai and others accused in the murder of SD Bhutia by the Sessions Judge, South and West District, the State has gone on appeal to the High Court against the acquittal.
The State filed the appeal challenging the acquittal, and on 30 August, 2011 the High Court admitted the appeal.
At the same time the court also issued a non bailable arrest warrant against co-accused Tenzing Tamang of Gyalshing, Tikjek. The State has gone to the Sikkim High Court in appeal against the acquittal of Rakesh and Tenzing Tamang.
It is informed that Tenzing was not in judicial custody at the time of the appeal following which the court directed the West District police to arrest him. At the same time, a production warrant against Rakesh Rai [currently lodge at the State Jail] has also been issued.
