Lachen says NO to mineral water bottles!

GANGTOK, 03 Feb: On the occasion of World Wetlands Day on 02 February, the Lachen Dzumsa consisting of the Pipons, Gyambos, Chultimpa (representative of Lamas),along with the public of Lachen has decided to announce a ban on mineral water bottles in the village of Lachen and above from the upcoming tourist season. This decision has been made as an initiative for conservation of the holy lake of Gurudongmar situated at 5183 meters, which over the years has been growing as a tourist destination in the state. The lake area is a biodiversity hotspot and also highly significant as it is one of the main sources for river Teesta, and believed to be touched and blessed by Guru Padmasambhava. Receiving more than fifteen thousand visitors annually in the form of pilgrims and tourists, one of the major threats to the holy lake is from garbage disposal.
This was clearly indicated during the cleanliness campaign organised jointly by WWF-India and Lachen Tourism development Committee in collaboration with the Lachen Dzumsa around the lake side, on the occasion of World Environment Day 2011, which brought out 30 big sacks of tins, plastics of which a large part was mineral water bottles.  Not only Gurudongmar lake, an excessively huge amount of empty mineral water bottles were brought out during the cleanliness drive in Lachen Village also which highlighted an immediate concern for management of such garbage.
Understanding the need for having a proper garbage management and regulation process in place, Lachen Dzumsa, with assistance from LTDC and WWF will develop a strategy for monitoring of the garbage that goes up to the lake, and ensuring that it is brought back to Lachen. A proposal for construction of a garbage segregation chamber at Lachen is also in the pipeline. While all items that produce garbage cannot be regulated, the mineral water bottle is one such product that can easily be done away with, by provision of a safe alternative. Tourists will have to sensitized on the matter so that they understand the reason for the ban and also come to realize that natural mountain water is safer and healthier than those packaged and sold in plastic bottles. With the decision of this ban, Lachen becomes the first village in Sikkim to ban the use and sell of bottled water.
The model will look into possibility of complete ban on the use of bottled water in Lachen and Gurudongmar Lake with promotion of filtered water for the tourists at these villages. Proper testing of the water being provided in place of mineral water will be conducted by certified agencies to assure tourists on the safety of the drinking water.
After a series of meetings with the local stakeholders in Lachen, finally on the occasion of the World Wetlands Day, the Lachen Dzumsa proudly announces the strict ban on use and sell of bottled water in Lachen from the coming tourist season. This Dzumsa resolution will be imposed on all Tourists visiting Lachen, local Shops, hotels and the general public, and a fine will be prescribed by the Dzumsa against offenders. The local area MLA Mr. TW Lepcha has supported this positive initiative taken by the Lachen Dzumsa for tackling the garbage menace. Lachen Dzumsa looks forward to help and cooperation from Tourism Department, TAAS and Police Department to make this ban successful.

Our Constitutional Federalism-its exceptions and limitation.

News about team Anna agitation towards bringing about Jan lokpal bill has ended for a moment albeit raising an important question of the constitutional law in our minds. Debate took place in the houses of parliament striking the root of the federal structure enshrined in our constitution. Can there be a uniform legislation enacted by the parliament, given our constitution’s federal structure, under Article 253 that provides for both the Lokpal at the centre and lokayukta in the states? This is besides how and what should constitute a Lokpal? As a student of Law, pulled by my insatiable appetite for higher learning, I tried to flip through the pages of the constitutional law with which I have been out of touch for years now.
Article 253 deals with the legislative relations between centre and states. The chapter 1 of part X1 actually begins by Article 245 which provides that parliament can make laws for the whole or any part of the territory of India and so are the legislature of the states making laws for the whole or any territory of the states, deriving the legislative powers to make laws subject wise under Article 246.
Question arose as to why under the constitutional schemes of things that the Parliament enact laws through the Lokpal and the Lokayukta Bill, 2011 under Article 253 of the constitution in one go, making states compulsory to enact Lokayukta subsequently in their states, should the parliament passed that bill, 2011, thereby undermining the legislative authority of the states? Why parliament limits itself to making laws for the constitution of the Lokpal only at the centre, leaving the domain of legislation making of Lokayukta to the states itself?
It is understandable that besides owing business of making laws, parliament has certain obligations to implement the international treaty, agreement or conventions made or signed with any other countries at any international conference, associations or body. One such international treaty is the UN Convention against Corruption, which was signed and ratified by India. Article 6 of the Convention envisages a specific obligation for member states to establish regulatory bodies that prevent corruption. In order to implement this conventions signed by our country to fight against corruption, it was incumbent upon India as a nation to frame laws. While doing so, Article 253 has an exception to the rule contained under Article 246 and gives power upon parliament to make any law for the whole or any part of territory of India. Therefore, the Lokpal and the Lokayukta Bill was brought by the government under Article 253 to implement the UN convention within this exception clause although it impinges upon matters belonging to State list for setting up Lokayuktas in the States.
Thus, the competency of the state legislature and powers to make laws in its State list is subject to parliament’s power to make any laws under Article 253. Interestingly, once the laws are framed obliging those treaties, the federalism constraints imposed by Article 245 and 246 will be removed and the total field of legislation is opened to parliament. It has a non-obstante clause like Article 375F of our Constitution and takes precedence over other Article contained in this chapter of part VI of the constitution.
Parliament’s powers to make laws for states in implementing those treaties or convention was uphold by the Supreme Court in many cases including those which were referred to by the President of India under Article 143(1) of the constitution in its advisory form. In the court’s words, “Article 253 deals with legislative powers, and thereby power is conferred upon parliament which it may not otherwise possess”. Furthermore, under the Directive Principle of State Policy, states are supposed to foster respect for international laws or treaty obligations signed by its nation.
We already have a glaring case in India apposite to Lokpal controversy. In order to implement the Paris Principles, 1991 for better protection of human rights, the parliament has enacted the laws for the constitution of Protection of Human Rights Act, 1993 under Article 253 itself which provides for constitution of National Human rights Commission at the centre and State’s Human Right Commission in the states as it would be like the Lokpal and the Lokayuktas.
Unfortunately, arguments raised in the parliament on such a crucial federalism issues were polemical and exaggerated more in tone and substance. Here, the role of Anna team is felt, nevertheless our parliament is already obliged to have laws in place to fight against corruption. Now the bill having jolted with so many ifs and buts and being stalled in the Rajya Sabha from passing it, it is assumed that it is kept under rest and recovery to be back soon, not killing it all together.

HRDD clarification of SSA guidelines and quality issues

GANGTOK, 02 Feb: The Sarva Shiksha Abhayan (SSA) is a centrally sponsored scheme. It is a flagship program of the Government of India. It is being implemented in the States by the State authorities but it has its own design and implementation features mandated by the Central Government.
It is now redesigned to be totally in synchronization with the Right of Children to Free and Compulsory Education Act, 2009.
Teacher qualifications, training and recruitment are covered in great detail in the framework of implementation.
The Government of Sikkim is desirous of implementing the said Act totally. This will be the bulwark of the Government’s total quality education mission. Hence there can be little compromise in this respect. The future human capital of our State is at stake and the caliber of teachers is central to the process of high quality delivery. In view of the above, the HRDD had placed advertisements in December 2011 seeking applications for employment under the guidelines set by SSA. The roles were advertised as being ad hoc and having a one year tenure, similar to those advertised in 2010. This form of recruiting is in line with the tradition of upgrading the skills of the teachers and also ensuring that the teachers meet with the qualification criterion as laid down by the SSA framework. In this design qualification criterion will not only be met but also positioning of teachers to remote schools which perennially suffer from lack of good teachers.
Hence more than 4,509 candidates were given the opportunity to face the interview this year.
It is therefore not possible to deny so many candidates from different Districts of the State an equal opportunity to the said jobs for the sake of a few when it was very clear that there would be a relook at the process when the appointments were given in March 2011.
It is understood that there are a few persons who are not desirous of following due process but would like to take the matter into their own hands by going on a fast. We sincerely hope and advise them not to be misguided thus. They should give up their fast. They need to wait for the result of the interviews in which so many young graduates and others have given their time based on the terms published.
We would also like to place on record that those who are on dharna have also taken the interview for the ad hoc posts for the current year. In fact, they have a better chance of selection compared to first time candidates since their past experience has been given due weight in terms of bonus marks in the interview. Thereby the department has duly recognized the service rendered by them by granting them bonus marks in accordance with the number of years they served and at the same time has given equal opportunity to many other qualified local candidates to compete for the ad hoc posts.
One should understand and appreciate the fact that such opportunities cannot be restricted to a selected few but to all eligible local candidates, in the interest of fairness and justice.

Common Platform to being agitation with ‘Pratiwad Rally’ at Gyalshing Bazaar

DEMANDS OFFICIAL NOTIFICATION ON THE SCRAPPING OF TING-TING AND LETHANG POWER PROJECTS FROM THE STATE GOVT
GANGTOK, 02 Feb: Common Platform against Ting-Ting, Lethang and Tashiding Hydel Power Projects announced the launching of a “physical agitation” against the three hydel power projects on the Rathong-Chu river in West Sikkim today. The Common Platform, comprising of members from eight different organizations against hydel projects, will begin its agitation with the ‘Pratiwad Rally’ on13 February at Gyalshing Bazaar. Members of the Platform also started distributing pamphlets for the same today.
Addressing a press conference, All Sikkim Educated Self-Employed & Unemployed Association [ASESE&UA] president, Nawin Kiran stated that although there have been news reports on the scrapping of Lethang and Ting-Ting hydel projects, no official gazette notification has been issued by the State Government so far. On the same, he added that until this happens the Common Platform will continue its movement at different levels.
Common Platform spokesperson, Tenzing Chewang Bhutia mentioned that as these projects fall under the 10-km radius of a National Park, so technically Ting-Ting and Tashiding projects have not received the environment clearance from the National Wildlife Board. He further added that the protest in West Sikkim shows that the people are against these projects.
Welcoming news reports on the scrapping of the Ting-Ting and Lethang projects, Mr Bhutia however questioned the government’s interest in continuing the Tashiding project. He further demanded that the government confirm the scrapping of these projects through an official notification.
“We demand the government to apply the same logic behind scrapping the Ting-Ting and Lethang projects and also scrap the Tashiding power project,” said Mr Bhutia.
Citing the statement of the Power Minister published in a local newspaper that these projects would generate revenue, SIBLAC convener, Tseten Tashi Bhutia questioned that if the people do not want the project then what is the use of the revenue. He further stated that the State government needs to choose whether it is for its people or the power developers.

State Cabinet takes decision on 3 HEPs in West Sikkim

LETHANG AND TING TING SCRAPPED, TASHIDING "UNDER EXAMINATION"

GANGTOK, 01 Feb: The state government has finally taken its decision on the three hydro projects under scrutiny in West District. Two projects, namely, the 96 MW Lethang and the 99 MW Ting Ting projects have been scrapped by the government. As for the third project, the 97 MW Tashiding hydro project is ‘under examination’. This is the decision of the state government a month after the high powered committee under the Chief Secretary was constituted to examine issues related to the implementation of the 3 projects and make recommendations to the state government. The decision to scrap the 2 projects and further examine the status of the Tashiding project was taken at the state cabinet meeting held on 25 January.
The decision on Ting Ting and Lethang projects were not so hard to take as there have hardly been much investments or construction activity related to these projects. In fact, as regards the Lethang project, it had not even been accorded approval by the National Wildlife Board. The National Wildlife Board had rejected the project proposal for the Lethang HEP in November, 2010. As regards Ting Ting, the project was in the initial phases of land acquisition.
As for the 97 MW Tashiding project in Tashiding – Yuksom constituency and being developed by Shiga Energy Limited the state government will ‘further examine’ the project. In fact it is informed the power developer has spent more than Rs.100 crore already and the project is in an advanced stage with tunnels and adits being constructed including the colony for the officer’s quarters. The land acquisition has also been completed and the site of the power houseidentified and approach roads under construction. With the power developer having invested such a huge amount there will be complications if it’s taken off the grid and legal repercussions cannot be ruled out. Only recently the affected people living in the project area had formed coordination committees to supervise the implementation of various works which the project would entail in their area.
The decision of the state cabinet is obviously based on the report of the high powered committee which had submitted its report to the government last year itself. The opinion of the committee on the projects was that it should be scrapped; this opinion had then been forwarded to the Law Department. The cabinet meeting of 25 January was the first cabinet this year during which the report of the committee was put up and discussed and finally, decided upon.
Several organizations including Buddhist organizations had made several representations to the state government raising concerns about erosion and disturbance of certain religious and cultural symbols attached with the Rathong Chu river on which all the three named projects were to be developed. The Minority Commission had also taken up cudgels on behalf of the protesting associations and organizations on similar grounds and had even written to the Prime Minister.

Music to pave way for an AIDS-free Sikkim

JUKE BOX, NIGHTMARES, DEATH SQUAD, DAMAGERA, AND FUZZY LOGIK IN THE FINALS OF THE RED RIBBON SUPER BAND CONTEST
ANAND OBEROI
GANGTOK, 01 Feb: Red Ribbon Super Band Contest is one platform which has brought together different generations of rockers from all over the state to perform on one stage. Who would have imagined that a young death metal band would emerge from a remote village and jam with big names in the rock n roll circuit here? This is what makes this competition one of the biggest rock fests to ever hit the state.
Red Fest is an initiative of Sikkim State AIDS Control Society [SSACS] to reinforce the messages on HIV and AIDS among the younger generation. 63 bands from across the state had participated in the contest out of which 10 bands made it to the semi finals at the Namchi Municipal Hall on 30 January.
In what turned out to be one of the toughest times for the judges, five top bands from the state were selected to fare against each other at the finals scheduled for later this month.
According to Uday Rai of Serenity Home which is also one of the organizers the five bands selected for the Grand Finale of Red Ribbon Super Band contest are Nightmares, Death Squad, Damagera, Fuzzy Logik and Juke Box from Gangtok and Death Squad, a death metal band from Namchi. It may also be added that Juke Box is the only band that has a female vocalist.
“According to the judges, the quality of performances is going up with every song of every round. Like one judge puts it, “the talent we have seen here is tremendous. With a little guidance and dedicated practice every band can be up there with the greats.” adds Uday.
The judges for the competetion comprised of eminent personalities namely Albert Gurung, Surja Solomon Rai, Diwash Rai, and Donald Lepcha.
He also says that competitions such as these should be an annual affair which will take the message of an AIDS-free society to the regional and then the national level. He informed that are invited for the finals to be held in Gangtok for which the date and venue will be decided soon. He added that the finals will also be an event which will have veteran bands from the state performing to pay tribute to Late Stephen Namchu, a local hero who had music in his blood.
With ‘Juke Box’ performing the composition in their classic rock style and Damagera doing the number in their “happy metal” [a term they use for the death metal they play] version, the crowd could not help but asking for more since the bands gave justice to each and every number they belted out.
Speaking to NOW! Siddhartha from Damagera said that they played their self compositions “Pristine” and “Damned for Eternity” which was well received by the audience. He added that Sikkim has never seen a bigger fest than this which has brought both veterans and new comers together on one stage.
Similarly, Dominic from Juke Box which has two members for whom this was the first performance said that no one actually needs drugs and alcohol to enjoy or play great rock and roll music. “I am pretty sure that this fest is trying its best to clear the misconception amongst the youth that music goes well with substances of abuse. The message that music is a drug in itself has gone through and we will take it as an achievement if we are able to convince even one youth from refraining from these social evils through our music,” he explains.
The semi final was a great show with all the bands giving it their best shot. The judges also commented on the new trend amongst the local bands which was to play their own compositions rather than covers. “Just a Phase” a song with the lyrics given by SSACS was also a treat as the music changed from band to band who performed the song as per their own genres.
What also makes the competition a perfect platform is that the message of an AIDS free society and awareness on drug and alcohol addiction is also being highlighted through the different bands that performed to a packed auditorium.
Sharing his views on the competition, Khituk T Lepcha who drove all the way from Gangtok to witness the semi finals said, “I am very happy and proud that we have such talent within our small state. MTV has held a similar competition at the national level which had around 200 bands participating and here there are 63 bands only from our state, this shows that we have the talent which has to be molded through programmes such as this.”
It may also be mentioned that Red Fest is being implemented in three stages namely, the Positive intervention in Schools, The Red Ribbon Super Band Contest, and Red Five open football tournament. Red Fest has been organized by SSACS in association with Hope Foundation, Serenity Homes, Recovering Users’ Network (RUN), and Sikkim Network of Positive People (SNP+). Nayuma Television and 93.5 Red FM are the official media partners of Red Fest. The audio-visual department is being managed by MAARK Pictures, Gangtok
