The general body of the Bar Association of Sikkim has expressed unanimous “shock and dismay” over what it describes as a “horrific incident of Police brutality” targeting a member of the bar. The incident in question is reported to have transpired on the afternoon of 12 Oct at the main gate of the District & Sessions Court premises at Sichey, Gangtok, when advocate JKP Jaiswal, a senior member of the BAS, was allegedly assaulted by two police inspectors. A BAS press release contends that the assault took place in front of the hundreds of people gathered there for the declaration of the municipal election results. An FIR has been registered against the two cops in question, the release informs.
The BAS stand was confirmed at a general body meeting held on 13 Oct. Since one of the police inspectors accused in the case is also attached to the Sadar Police Station, the Bar Association has expressed concerns over the fairness of investigation and has resolved to approach the DGP with a request to ensure fair investigation and consider suspending the PIs in question for the duration of the investigation of the case as well as the department proceedings.
“The BAS also resolves to request the Director General of Police to appreciate that the attack by the two named Police Officers is not only on the body and mind of Mr. J.K.P. Jaiswal (Advocate) but it is an affront to the administration of Justice in the state of Sikkim in as much as the concerned Police Officers have obstructed the cause of justice by physically restraining and assaulting an Officer of the Court in his discharge of his duty,” the BAS resolution further details.
