GANGTOK, 05 June: Sikkim Police today informed the High Court that the arrest of Martam-Rumtek MLA Dr. Mechung Bhutia was no longer required as the Singtam Police Station has already completed its investigation and that the charge-sheet has been sent to higher authorities for consideration for filing in appropriate court of law. The MLA, it may be recalled, has been booked on charges of criminal intimidation and had moved a bail application in the High Court.
Following the clarification by the Investigating Officer, the High Court observed that the need for bail hence becomes redundant. The Court further directed that the accused MLA attend his trial court hearings as and when a notice is served for his presence.
The court has also directed Dr. Bhutia to cooperate with the investigation.
The Singtam Police Station completed its investigation within fifteen days of registering the case. The MLA was booked under one non-bailable section [353] of the IPC and other four bailable sections 447, 341, 427 and 506 [criminal trespass, wrongful restraint, assault to deter public servant from discharge of his duties, punishment for criminal intimidation, mischief causing damage of property] of the IPC.
Meanwhile, Dr. Bhutia has submitted a fresh application to the Sikkim Legislative Assembly for taking oath of office. He had missed the first day of the Assembly when all other MLAs were sworn in, it may be recalled.
